THIS IS A NATIONAL GUARD TITLE 32 EXCEPTED SERVICE POSITION. This National Guard position is for an ATTORNEY-ADVISOR (GENERAL) - TITLE 32, Position Description Number PDD1240000 and is part of the KY SJA, National Guard.
MINIMUM REQUIREMENT: A bachelor of Laws OR Juris Doctor degree in law (LLB or J.D) issued by an American Bar Association accredited law school -AND- Be a current member of a bar with a valid license to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia SPECIALIZED EXPERIENCE: Must have at least 24 months experience as a professional Attorney-Advisor. Knowledgeable of the National Guard mission requirements. Ability to recognize and identify complex constitutional, state-federal, and/or military-civilian jurisdictional issues and articulate them in the appropriate forum or context. Experience conducting legal research in connection with cases pending administrative hearings, trials, or appellate courts. Experience researching and providing legal advice in functional areas such as Administrative, Labor, Litigation, Domestic Operations Law, Ethics, or equal employment and affirmative action programs. Experience conducting legal research, investigation and negotiation, and provided legal advice, opinions, recommendations and legal memoranda. Experience influencing managers or other staff officials to accept and implement findings or recommendations. Experience planning and scheduling work to create effective and efficient procedures. Experience mentoring, training, and guiding employees on legal programs and legal procedures through assigned tasks. Experience balancing office case work-loads and providing advice and direction. As an ATTORNEY-ADVISOR (GENERAL) - TITLE 32, GS-0905-13, you will act as a legal adviser and attorney for the Kentucky National Guard (KY NG), responsible for the formulation of state legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state constitutional, civil, criminal, labor law; international law and treaty agreements; trial defense; and a full spectrum of expert legal advice. Advise on legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted and emotionally charged issues. Advise leaders on the appropriate use of National Guard personnel, resources and status issues for critical and diverse missions, emergency responses, contingencies and exercises, ensuring execution is consistent legislative intent, executive orders, current U.S. Codes and state laws, court decisions and agreements. Serve as the KY NG litigation point of contact. Represent the KY NG in all legal matters in state and Federal courts of original or appellate jurisdictions. Conduct investigations of fact and legal sufficiency; advise on administrative remedies; develop the trial strategy, content and means of presentation, and trial delivery; make motions; and conduct post-trial duties. Prepare litigation reports, briefs, pleadings and other papers associated with litigation. Provide acquisition and fiscal legal advice to the KY NG United States Property & Fiscal Officer and military advisers. Advise contracting officers, review contracts, procurement actions and real property matters involving Federal and state funds for legal sufficiency, appropriate titling and claim initiation or resolution actions. Act as the Adjutant General's representative in third-party proceedings under Federal labor-management and equal employment opportunity statutes and regulatory provisions. Represent the KY NG as a trial attorney before investigators, administrative judges and arbitrators. Possess a thorough understanding of controlling labor laws, regulations, labor arbitration, collective bargaining agreements and pertinent labor relations practices. Review collective bargaining agreements for legal sufficiency. Serve as the state Ethics Adviser. Review sensitive financial disclosure statements for General Officers and other key personnel. Provide or participate in various training activities, prepare reports and provide counsel on complex ethics issues and policies. Serve as claims officer for the KY NG. Provide oversight and guidance to the KY NG Judge Advocate's Legal Office, Legal Assistance and Preventative Law Programs, and supervise assigned full-time attorney and support staff. Coordinate provision of legal services throughout the state and oversees the assignments of attorney and paralegal personnel within the subordinate units in both the Army and Air National Guard to accomplish all legal support requirements.
